Will the Supreme Court stop the Democrat Party from using the "nuclear option"?
On CNN, Rep. Michelle Bachman revealed that the Democrat Party is planning on using the unconstitutional "nuclear option" for the first time in history in order to force a government takeover of health care. Can the Supreme Court stop them?
The nuclear option was invoked by the GOP in an attempt to end the filibuster on judicial nominees. Reconciliation is NOT the same thing as the nuclear option and neither is ‘illegal’. I suppose when the GOP considered using the nuclear option 2 or so years ago, you also wanted the supreme court to step in or are you just catching up and caring now? I believe you to be a hypocrite.

Reconciliation has been used many times before, including on health care related issues like COBRA.
Since 1981, it’s been used 22 times, 16 of which were done by Republicans, including the Bush tax cuts.
by the way, the Dems are using reconciliation, and that’s a totally different thing than the "nuclear option."
Whether they do or not the bill on its face is unconstitutional and its only a matter of time before Scalia and company throw down the judicial smackdown on Obama and friends.

The Democrats will be using reconciliation, which is NOT the nuclear option. As a matter of fact, the only time the nuclear option was threatened (that is, changing Senate rules and declaring the filibuster to be unconstitutional) was by the Republicans, when Bill Frist threatened it to stop filibuster of some Bush appointees.

The Democrats have not stated that they will try to use the nuclear option. They have stated that they will use reconciliation. That is an entirely different concept.

The use of the nuclear option involves changing the Senate rules. Reconciliation does not.
The bill itself is unconstitutional not reconcilliation.
